Just because a DM is not occupying an NPC does not mean that NPC does not see, hear and sense things going on around them.
Committing a crime in front of an NPC and ignoring them just because they are not being controlled is lame and very poor behaviour.
If a DM is not on to help you with something you need an NPC for then use the forum to ask for help and get a DM on.
