Operating a Business Without a License
- Fine: 750 lions (Second Offense: 10,000 towards registration)
- (Second Offense: Imprisonment: 3 days)
- Banishment: 5 days
Where does one obtain a license, also what constitutes this? If a person overhears someone in need of something and can make said ware, does this law apply or no?

You can obtain a merchant license from any DM in game. It's a pretty quick process once you catch one of us around.
As for the other part, there's something to be said for discretion and common sense. Much as in the real world, there will always be criminal activities going on. The distinction to make is between which of these are IC laws and which are OOC rules, and it's not always entirely obvious. (Though hopefully they are applied by the team with consistency)
The merchant license laws are Cormyr Laws, not FRC rules. The prices charged for items, however, are covered by both Cormyr Laws AND FRC Rules.
The reason the price guidelines are OOC Rules is to prevent people from twinking through undervalued sales. For instance, selling your OOC buddies a buncha +2 str rings for 1K each is a clear violation of FRC Rules.
Maybe one day we'll get that classic mafia style merchant guild and see some people getting their knees busted for IC violations, but until then it's a little bit up in the air. I have seen people get caught IC and have all their goods stripped in the past. It's not pretty.

Your question isn't quite the same as some others, but some parts of it are. Questions related to the Merchant License are reoccurring. Asking the same question again isn't always a bad idea, it's just better to ask it in the context of already posted answers when possible. If the preference is to bump existing topics, and make separate threads for unanswered questions only, I can certainly do that.

I bumped a number of merchant license threads. You may note that a number of them were cross-posted in summer 2014 when a change to the license was made. There have been no changes to merchant license procedure since that time.
As of the update that was cross-posted at that time, there is a list of minimum prices for some commonly traded goods on the license itself. These values supersede other rules for determining the minimum price of a listed item type. If an item is not listed on the license, the other rules about minimum pricing (as explained in those threads) still apply.
In general, the preference is to bump existing questions if they're about the same thing. That way corrections to existing information can be made simultaneously, if such corrections are needed. Of course, it's understandable and accepted that people are going to prefer to ask their questions in their own words rather than slogging through old inquiries.
DM Syds really did answer your specific questions in this DM Q&A. I just know you have a fair few questions, and would prefer to see if we can frame some of them in past answers.
