I don't know a single player who will emote that each time a new person walks up and if they do then they won't be able to if someone comes up behind them. Besides, assuming a bird is perched is what the sane person will automatically assume when seeing a bird "hovering" so there isn't any need to emote it. No, sane people realize truely sane people are going to take offense at you wording things in such a demeaning manner. And if a person doesn't want to emote that all the time, they can do what others do, not summon the bird in town, simple as that. There's no reason for it to be physically present. At such a point, a "sane" person can reasonably think that the creature is flying free, perhaps moving in a small circle, but not on the owner's person. I've seen people emote bird's on shoulders, dire rat animal companions sticking out of pockets, and other forms of RPing the creatures presence without having the creature actively summoned. If you don't want to risk it, leave your creature unsummoned.

I'd like to expand on what Boozehound is saying.
So far all we have seen here are IC reasons why it's alright to kill a familiar in town. So far all we have seen are people talking about the mechanics of how to tell if a creatures is a familiar or not.... again IC.
What we have not seen is the OOC consideration for the player that brought said familiar in.
Now, I understand that in the particular situation that prompted Nevajas to post what he did, that the players in question ignored several IC warnings and OOC tells to put thier familiars away. In this particular situation, the IC actions were warranted.
However, this is not the first time I have seen this situation happen. Some of the times that I have witnessed it, it's occurred against new players to the server. Some of those times those new players never return to FRC again.
No one here has mentioned the fact that from the starting point in the Welcome Area all the way until one reaches the guard house in Isinhold is there isn't any notification of the rule of no familiars in town. Nor -- from what I can see -- do we make mention of it here on the forums under any rule section. This will be rectified by the crew in the coming days.
Until that time, however, what we would like to see from the player base (more specifically our vet players) is a little more decorum when handling this situation. In the future, please give more then just one line of warning and give the player in tells some OOC words about the town law on top of the IC warning before you start killing the familiar.
Discussion with the crew still goes on in regards to the "Familiar in Towns" law. We'll give further details in time.
