Is there a rule on whether or not PC's can act as merchants and see items they find?
If you know that if you sell an item to an NPC merchant and you are only going to get 5000 gps, and the merchant will sell it for 40,000 gps, is it wrong (i.e. twinking) if you choose to sell the item to a PC for say 5000, 10000, 15000 or 20000 gps?

I certainly hope not because I have already done this with several old items hroth has run through. I mean, it should be a part of the economy for the players that once they need a new item which they already have one of (ie boots of dodge +1 and want boots of dodge +3) they should be able to sell their old item to another PC. I have also already seen MANY posts on the in-game message board that has people selling things. I would think it rather unfair if I pay 40K for boots of dodge +1 and all I can reap from it is 5K (my selling it that low is not because I have poor appraise either) because I am forced to sell it to the merchants.
Now the only thing I can think of that would be twinking is if say I had a buddy join the server and I wanted to give him some awesome items, and to make it legit I sold it to him for MUCH less than the actual value (1-5% of what it would actually cost).
Of course, you should be able to make the judgement call as to whether the item you are about to sell would be twinking. I.e. you wish to sell boots of dodge +3 and a level 1 comes up to you and wants to buy them. Most characters that can afford to buy the item from you at 10% of the store cost prolly could use the item and it would not be considered twinking. Of course if that level one has the 10,000 gold that you asked for the boots, you kinda gotta begin to wonder where he got that much cash *taps chin and contemplates*.

Oh and P.S. I would sell most things at a rate of 50% of the items store value, this way you make some decent cash and the other PC feels like he is getting a good deal.

The main thing here is not to twink in the guise of selling.
Basically the stated rules are that you are not to give an item to a player who couldn't get it themselves. This is really no different.
In the case of offering "merchant" services to other PC's, this is ok as long as it is reasonable that they would be able to get the item themselves within a short period. I understand the need to sell items to other PC's, but we certainly envisioned that these sales would be between PC's that have a reason to interact. There should be no sale of say +3 items to any player below 10th level. Now, I would rather use the old common sense rules on this rather than try to enforce some rule on it. Just remember if it feels illegal, it is, heh.
Remember that the gold is virtual, but the virtue is real.

as i understand it player to player transactions are perfectly legit. the only restriction is item power compared against player level.
don't sell low level chars +3 weapons or anything you wouldn't realistically be able to aquire yourself at that level.

Many people use the in-game boards to post the sale of certain items. I havent tried this so i dont know how helpful it would be (actually i did post something, but no one ever responded to it, so I figured that instead of lugging it around, might as well get some cash for it). The Seeker posted something about a short sword +3 in the regal griffin, which caused some discussion about the possibility of this idea (open air markets for PCs to sell to each other and/or auctions). Problem is that not everyone reads this website, and not everyone reads the in game boards...
What would be really nice, in my opnion, is if there was a merchant (NPC) that you could just drop your item off with and then other PCs could come along and look at his wares, and if they bought your item, the NPC would hold your gold until the next time you came to visit him. You would set the price you wished to sell this item at and thus the dms could monitor the item trade. However, I know the main problem of this would be server lag, as it would tax the server to remember what your item was and the money you would need to recieve.

I would love to have a auctioneer/market merchant...but I have seen this done once on a server alot of us DMs came from....and it did cause an enormous amount of lag/stress on the server, so I'm afraid, unless an ingenious way of doing this surfaces, that this won't be a possiblity

You could set up one of the buildings in Isenhold as an auction house. Put a bulletin board there where people list items they wish to auction, and others post their bids... like E-bay. Better yet, put it in Redmist so you can possibly take some of the traffic out of Isenhold. How about that?

There is already an area in Eveningstar called the Market Square I believe... I could tag this and a couple of areas as player merchant areas and set up a couple of local message boards to serve the purpose. Let me know if everyone thinks this is a good idea.
